OLATHE, KAN - FBI agents from Washington, DC were in Olathe, Kansas Monday after a shootout with cops left a wanted man in critical condition. The shooting happened just after 7 p.m. Sunday when FBI agents went to arrest a man outside a Subway sandwich shop at 151st and Ridgeview. When agents surrounded the man, he pulled a gun.

"The subject displayed a weapon pointed it at officers and gunfire was exchanged," said Bridget Patton, FBI spokesperson.

The suspect was wanted on an outstanding warrant for aggravated assault. FBI agent Brian Trushon said agents had no choice but to exchange gunfire.

"That's never the intent," said Trushon. "That's never what is hoped for. It's planned into the actual arrest should it take place, but that was the decision made by the subject to have a firearm and to try to use that against the agents and the police officers."

The suspect's truck was riddled with bullets and the front and driver's side windows were shattered. All this while two Subway employees were conducting business as usual with a mother and child inside.

The suspect was taken to an area hospital in critical condition.

As with any shooting involving FBI agents, the investigation has been turned over to a team from Washington, DC.

"It is the FBI shooting team," said Patton. "They will come in and determine what happened. They will determine the path of bullets and how the gunfire was exchanged."

Police have not released the name of the suspect involved in the shooting, but he is listed in serious condition.
